Podsafe Music Network Bans Adam Curry?
The Producer Terms of Use limit subject matter that can be discussed in podcasts that use the network’s music:
8. You agree that a Broadcast or Music Podcast will not:
a. contain hate material, promote violence, discriminate based on race, sex, religion, nationality, disability, sexual orientation, age, or family status, or contain any other materials deemed unsuitable or harmful to the reputation of PodShow or the Licensor;
b. promote or reference software piracy (warez, cracking, etc.), hacking, phreaking, emulators, ROM’s, or illegal MP3 activity;
c. promote illegal activities, deceptive practices or violations of the intellectual property rights of others; or
d. be advertised or promoted through the use of unsolicited bulk email.
I thought this was interesting and wonder if anyone had written about the biggest sprucer and (my understanding) part owner/founder of the PMN (via Podshow), Adam Curry, and (to my mind his violations of these terms of agreement (on his Dailey Source Code). As it happens, someone had. Over at Mobilepodcast.org, there was the following titled post Curry Violates Terms of Service. Basically the post points to the fact that lots of Podcasts talk about pirating stuff (normally indirectly) and also mentions that Adam talks about smoking illegal substances.
This isn’t the violation of the agreement that I was thinking. I was thinking of a bigger one. One that he whole heatedly promotes. One that is in just about every show! One that he freely admits and blatantly flaunts. What is it? Well look at point b & c:

You worked it out yet? Its the Mashups! He freely admits that these are in direct violation of the artists Intellectual rights. I wonder if Podshow will take any action against Adam (I bet not). I have actually asked them if they will be enforcing there agreement and will post a follow-up later!
